Article 2 Definitions

In these general terms and conditions  we will use some concepts. Below you will find the definitions of these concepts.
When we talk about Pottery Forms Europe, we mean the Pottery Forms Europe company that offers you services, materials and / or remote access to digital content.
(see also art. 1)

YOU are the natural person who does not trade for purposes related to your trade, your trading, craft, or professional activity.

Pottery Forms Europe concludes an agreement with you remotely. This is an agreement between Pottery Forms Europe and you that is concluded via the website of Pottery Forms Europe, whereby up to and including the conclusion of the agreement, one or more techniques for distance communication are exclusively or partly used.

Remote communication technology is a means that can be used to conclude an agreement, without you and Pottery Forms Europe having to be in the same room at the same time.

The right of withdrawal is understood to mean the possibility that you have the right to withdraw from the distance contract within the cooling-off period. The reflection period is the period within which you can exercise your right of withdrawal.

A durable medium is any tool, including an email, or messenger / whats app message that allows you and Pottery Forms Europe to store information addressed to you in a way that future consultation or use during a period that is tailored to the purpose for which this information was tuned and that allows unaltered reproduction of the stored information.

To avoid confusion, when we talk about a day, we mean a work day.

Article 3 Applicability
These general terms and conditions apply to every offer of Pottery Forms Europe, both for the services offered, materials and / or access to digital content. Pottery Forms Europe will always bring these terms and conditions to your attention and refer to them.

Article 4 the offer
When Pottery Forms Europe makes you an offer, the digital content and / or services are described as completely and accurately as possible. Pottery Forms Europe also tells you what your rights and obligations are, if you accept the offer. This way you are able to make a good evaluation and assessment of the offer.

If an offer is only valid for a certain period of time, or if there are certain conditions attached to it, this will of course be stated in the offer. If there is an error or mistake in an offer, Pottery Forms Europe is not bound to adhere to the offer and has the right to withdraw and withdraw the offer.

Article 5 the agreement
The moment you accept the offer from Pottery Forms Europe and meet the (payment) conditions set with that offer, an agreement is concluded. Pottery Forms Europe will confirm this to you by email. As long as Pottery Forms Europe has not sent you a confirmation (also check your spam folder) You have the right to terminate the agreement.
When we conclude an agreement with you, you purchase the goods and / or services offered.

Article 6 right of withdrawal / return shipments
As long as the order has not yet been shipped, you can contact us by phone or email to cancel the order.
After shipment, goods can only be returned with an obtained return authorization.
This return authorization will only be granted if there is a valid reason for return (think of double order / wrong part number / incorrect delivery or quality problems with the product).
We hereby expressly state that there will never be a return authorization for products sold as "seconds", these goods are offered at a reduced price because they differ in size and / or quality.

Article 7 prices
All prices published and charged on our website include VAT. You will receive an official invoice by email.

Article 8 fulfillment of the agreement and additional warranty
Pottery Forms Europe guarantees that it complies with the agreement, the specifications stated in the offer and the reasonableness and / or usability and the legal provisions and / or labor regulations on the date of the conclusion of the agreement.

Article 9 Delivery and implementation
Pottery Forms Europe strives to deliver the ordered goods within 5 working days.
It should be explicitly stated that this does not take into account any delays in overloading the package services (think of busy periods around Sinterklaas / Dutch St Nicolas -  Dec 5th) / Christmas and exceptional situations).

In the unlikely event that, due to unforeseen circumstances beyond the reach of Pottery Forms Europe, such as illness and / or family circumstances, the Pottery Forms Europe are unable to fulfill the agreement, it will notify the persons who have entered into an agreement.
An alternative offer / date will initially be proposed.
If no alternative agreement can be concluded, it can be stated that Pottery Forms Europe remains in default and a refund on the amount payed will be made on request.

Article 10 Digital and written information facilities.
Pottery Forms Europe will compile the content of the written and digital files very carefully.
This content is of an informative nature and gives you advice without obligation. It is up to the recipient to determine how and to what extent these advises will be followed. The advice is not intended to encourage compelling acts or omissions. Therefore, achieving an intended result as a result of this digital content and instructions cannot be guaranteed.

Article 11 Payment
Goods ordered through Pottery Forms Europe must be paid in full in advance.
This will be done via the selection menu of the web-shop of our site.

Article 12 Complaints
Pottery Forms Europe makes every effort to keep the quality of goods and services high. In the unlikely event that you have a complaint about the materials received and / or the implementation of the agreement, you can submit a complaint. A complaint can only be submitted in writing by e-mail within a reasonable period of time after the goods and / or services received (think of a period of 5 working days after receipt of the goods as a guideline - slightly longer during the holiday period). When submitting the complaint, please state your invoice number and the article number that the complaint is about, we also request that you describe this complaint as completely as possible and provide it with photos so that we can get a clear picture. You may receive an email after receiving the complaint to provide additional information. If there are questions, we ask you to return these questions as completely as possible, so that we can form a clear picture of the nature and origin of the complaint.

After evaluation of the complaint, Pottery Forms Europe will try to resolve the complaint by mutual agreement as soon as possible, but no later than within 4 weeks. If it is not an agreement after the 4-week period, there is a dispute.

For all Pottery Form products, a description will be provided for the maintenance and storage of the products. Complaints about the quality of the products that are related to incorrect handling and / or storage of the products can never lead to compensation and or return of these products.

Article 13 Dispute
Only Dutch law applies to agreements between you and Pottery Forms Europe to which these general terms and conditions apply. The law determines which court has jurisdiction to hear the dispute.
