Article 1 – Definitions
In these Terms & Conditions, the following definitions apply:
Customer: the natural person acting for purposes outside their trade, business or profession.
Company: Pottery Forms Europe.
Distance Contract: an agreement concluded between the Company and the Customer through the webshop or other means of distance communication.
Products: all goods, materials, digital content and/or services offered by Pottery Forms Europe.
Right of Withdrawal: the possibility for the Customer to cancel a distance contract within the applicable withdrawal period.
Durable Medium: any tool, including email, allowing information to be stored and reproduced unchanged for future reference.
Article 2 – Applicability
These Terms & Conditions apply to all offers, orders, agreements and deliveries of Pottery Forms Europe.
By placing an order through the webshop, the Customer agrees to these Terms & Conditions.
Article 3 – Offers and Product Information
Pottery Forms Europe aims to describe and display all products as accurately as possible.
Obvious mistakes, errors, pricing inaccuracies or typographical errors are not binding and may be corrected at any time.
Offers may be subject to limited availability or specific conditions.
Article 4 – Orders and Agreement
An agreement is concluded once the Customer places an order and payment has been successfully completed.
The Customer will receive an order confirmation by email. If no confirmation is received, please check the spam or junk folder.
Pottery Forms Europe reserves the right to refuse or cancel orders in cases including, but not limited to:
incorrect pricing,
suspected fraud,
unavailable products,
payment issues.
If an order is cancelled after payment, the paid amount will be refunded.
Article 5 – Prices and Payment
All prices displayed on the webshop include VAT where applicable.
VAT is only charged for customers within the European Union (EU), in accordance with applicable tax regulations.
Business customers within the EU who provide a valid VAT number at checkout may qualify for a VAT exemption under the intra-community supply rules. The VAT number may be verified before the exemption is applied.
Customers outside the EU may be responsible for local import duties, taxes or customs fees charged by their local authorities.
Payment must be completed in full before shipment of the order.
Invoices are sent digitally by email.
The Customer is responsible for providing correct billing and payment information.
Article 6 – Shipping and Delivery
Pottery Forms Europe aims to ship orders within 5 working days.
Delivery times are estimates and may vary due to circumstances beyond our control, including:
courier delays,
holiday periods,
customs processing,
force majeure situations.
Pottery Forms Europe is not liable for delays caused by shipping carriers.
If a product cannot be delivered, the Customer will be informed as soon as possible and offered:
an alternative solution,
a revised delivery date,
or a refund.
Article 7 – Returns and Right of Withdrawal
Orders may be cancelled free of charge before shipment by contacting Pottery Forms Europe via email or telephone.
After shipment, returns are only accepted with prior return authorization from Pottery Forms Europe.
Return requests may be approved in cases such as:
incorrect delivery,
damaged goods,
manufacturing defects.
Products sold as “seconds” or discounted due to imperfections cannot be returned for cosmetic or quality-related reasons.
Returned products must:
be unused,
be properly packaged,
and be returned in original condition.
Return shipping costs are the responsibility of the Customer unless otherwise agreed.
Article 8 – Product Quality and Warranty
Pottery Forms Europe guarantees that products reasonably conform to the agreement and product descriptions.
Customers must follow all care, maintenance and storage instructions provided with the products.
Damage caused by improper use, storage or handling is not covered by warranty.
Article 9 – Complaints
If the Customer has a complaint regarding a product or service, the complaint must be submitted by email within a reasonable period after receipt of the order.
To process complaints efficiently, the Customer should include:
order or invoice number,
product information,
clear description of the issue,
photographs where applicable.
Pottery Forms Europe aims to respond and resolve complaints within 4 weeks.
Article 10 – Liability
Pottery Forms Europe is not liable for:
indirect damages,
consequential damages,
loss resulting from improper use of products,
delays caused by third parties.
Liability is limited to the amount paid for the relevant order unless mandatory law states otherwise.
Article 11 – Digital Content and Information
Any digital content, instructions or written information provided by Pottery Forms Europe is for informational purposes only.
Results achieved through the use of products, tutorials or advice may vary and cannot be guaranteed.
Article 12 – Privacy
Personal data is processed in accordance with applicable privacy legislation and the Privacy Policy of Pottery Forms Europe.
Article 13 – Governing Law and Disputes
These Terms & Conditions and all agreements with Pottery Forms Europe are governed exclusively by Dutch law.
Any disputes shall be submitted to the competent court in the Netherlands unless mandatory law provides otherwise.
